Eligibility
The promotional Winvitation Sweepstakes begins on September 10, 2019 and is open to existing and future holders of a free Winglio account, as defined in Winglio’s Terms of Service. Excluded from eligibility are the officers, directors, employees, agents, and representatives of the Sponsor, as well as members of the immediate families (defined as parents, siblings, children and spouses, regardless of where they live) or members of households (whether or not related) of such officers, directors, employees, agents, and representatives.
Prizes
By participating in the Winvitation Sweepstakes, participants are entitled to win the Winvitation Travel Voucher worth 2,500 EUR. The Voucher can be used to cover travel expenses to any world destination selected by the winner, including but not limited to accommodation, tickets, and other travel expenses. The voucher covers travel expenses for up to 2 persons. Up to 600 EUR can be credited as cash to the winner’s bank account or debit card, while the rest of the amount will be paid by the Sponsor directly to service providers selected by the winner.
How to Enter
By creating a free Winglio account, the user will automatically get their first Winvitation code as an entry to the next Winvitation Sweepstakes draw. As a part of the Winglio sign-up process, users will receive one or more email notices with the information about their Winvitation code(s), draw details, and other information relevant to their participation in the Winvitation Sweepstakes.
How to Increase Chances to Win / Winvitation Guru
Apart from the first Winvitation code received as a reward for creating a free Winglio account, users may earn additional Winvitation codes by inviting people to use Winglio by sending them a personal Winvitation link. For every invited person that creates a free Winglio account, a user who shared the link will be rewarded with one additional Winvitation code. Users who collect at least 4 additional Winvitation codes for 4 invited people will get the Winvitation Guru status and, therefore, qualify for permanent participation in the Winvitation Sweepstakes draw.
As Winvitation draw takes place regularly on a quarterly basis, on the first working day of January, April, July, and October, participants with the Winvitation Guru status are entitled to permanently participate in the Winvitation Sweepstakes draw with all Winvitation codes received before the particular draw, thus significantly increasing their chances to win compared to the chances of winning with only one Winvitation Sweepstakes code in a single draw. The total number of additional Winvitation Sweepstakes codes received by one Winvitation Guru is not limited.
Participants are allowed to post to the Internet their personal Winvitation link and/or our marketing materials, including but not limited to, banners and textual adds with their personal link integrated. Also, participants are allowed to share their Winvitation link via social networks and/or other communication channels with people who may be interested in using Winglio Services or participating in the Winvitation Sweepstakes.
Participants are not allowed to:
- Send any kind of information about Winglio or Winvitation Sweepstakes to anyone who does not expect such information;
- Send any kind of single or bulk spam messages that may be related to the Winglio or Winvitation Sweepstakes;
- Post their Winvitation link in any form to chat rooms, public comments, forums, or any other public place where such activity is not allowed by the service provider or the owner of such place;
- Post their Winvitation link in any form to public places, websites, or blogs where the content of such places, websites, or blogs may be inappropriate or illegal, including but not limited to pornography or illegal media content;
- Share or communicate any incorrect, incomplete, or fraudulent information about Winglio Service or Winvitation Sweepstakes that may cause potential damage to Winglio, Service Provider’s Corporate Partner’s, Winglio’s affiliates or employees, its current or potential customers, and/or any third party related to Winglio;
- Violate any of the provisions stated in these Terms and Conditions or Winglio’s Terms of Service, including but not limited to the provisions related to illegal and prohibited activities as well as provisions related to the intellectual rights and third-party content.
Winner Selection & Notification
Participants with one or more valid Winvitation codes received before the date of the draw are qualified to participate in the draw with those Winvitation codes.
The draw is separated into 2 rounds. In the 1st round, all valid Winvitation codes are imported into an open-source draw software which randomly selects 200 codes for the 2nd round pot. The 2nd round is a public draw which can be streamed at https://www.winglio.com/winvitation-draw. Starting from the previously selected 200 codes, the Software randomly removes 1 code every 10 seconds. The Winner is the owner of the last code after the other 199 codes have been removed.
The Winner will be notified by the Sponsor within 5 working days of winning the Prize. The Winner has 30 days after the draw date to claim the Prize and deliver to the Sponsor payment instructions for Travel Voucher redemption.
If the Winner is not reachable by the Sponsor or if, for any reason, he/she misses the deadline for claiming the Prize, it may result in disqualification, forfeiture of the Prize, or part thereof, and, at Sponsor’s sole discretion, selection of an alternate eligible entrant for the forfeited Prize, or part thereof, in accordance with these these Terms and Conditions, who is subject to disqualification in the same manner.
The alternate eligible entrant is considered the owner of the last Winvitation code removed from the draw prior to the selection of the winning code.
Rights / Obligations / Limitations
The Winner is allowed to redeem the Voucher in order to cover the following travel expenses:
- Accommodation expenses for 1 or 2 persons in facilities listed on Airbnb or Booking.com, except for the facilities in the Winner’s home country, in the amount of up to 2,500 EUR;
- Airplane/bus/train tickets for 1 or 2 persons in the amount of up to 1,000 EUR;
- Other travel expenses in the amount of up to 600 EUR.
The Winner is allowed to combine the allowed amounts and limits in order to redeem the Voucher in the most appropriate way, taking into the consideration the total redeemable amount of 2,500 EUR, with related transaction fees included.
The accommodation and ticket expenses have to be paid upfront directly by the Sponsor. The Winner’s obligation is to provide the Sponsor with all relevant information and payment instructions related to the payments of those expenses at least 3 working days before the payment deadline.
If the Winner fails to fulfill the requirement from the previous paragraph, the Sponsor may refuse to fulfill such payment request without an obligation to cover any potential loss which may incur for the Winner as a result of such action.
Up to 600 EUR for the coverage of other travel expenses may be paid, upon the Winners explicit request, to the Winner’s bank account as cash. The Winner is allowed to spend that amount as he/she sees fit, without further obligation to report such expenses to the Sponsor.
Any and all tax obligations that may be incurred in the Winners’ home country by virtue of winning and collecting any part of the Prize fall exclusively on the Winner, and cannot, under any circumstances, be considered as obligations of the Sponsor.
Any payment instructed by the Winner and paid by the Sponsor will be considered as a partially or fully redeemed Voucher, and such payment is not refundable unless otherwise agreed upon between the Winner and the Service provider who received said payment. If the refund is agreed due to any reason, such refund may only be made to the Sponsor, and the refunded amount may be used for a substitute payment in accordance with these Terms and Conditions.
The Winner has an obligation to deliver to the Sponsor at least 4 high-resolution photos showing them at the travel location, not later than 10 days after the trip has finished.
Publicity
Each winner hereby authorizes the Sponsor to use, on any media (including the Internet) in perpetuity, their name, photograph, likeness, voice, place of residence and/or statement regarding the Prize for publicity and advertising purposes, without any form of notice or any amount or kind of compensation or permission, except where prohibited by applicable law.
All copyright, trademark or other intellectual property rights in such Advertising shall be owned by Sponsor and/or its licensors and each winning participant hereby disclaims and waives any claim of right to such Advertising. Such Advertising shall be solely under the control of Sponsor and/or its licensors, and each winner hereby waives any claim of control over the Advertising content as well as any possible claims of misuse of such winning recipient’s name, likeness or voice under contract, tort, or any other theory of law.
Protection Of Personal Information
Unless otherwise authorized by the entrant, any personal information provided by the entrant when they enter the Sweepstakes will be used solely by the Sponsor and its authorized agents for the purposes of administering the Sweepstakes and Prize fulfillment. When entering the Sweepstakes, however, the entrant may give their express, opt-in consent to receive electronic messages from the Sponsor. All collected personal information the Sponsor or its authorized agents will be handled in accordance with the Sponsor’s Privacy Policy which may be found at https://www.winglio.com/privacy-policy.
Right to Void / Terminate / Suspend / Modify
The Sponsor reserves the right to terminate, suspend, or modify these Sweepstakes, in whole or in part, at any time and without notice or obligation if, in the Sponsor’s sole discretion, any factor or event arises that could interfere with the proper conduct, administration, security, or impartiality of the Sweepstakes as stipulated by these Terms and Conditions. Without limiting the generality of the foregoing, if the Sweepstakes, or any part thereof, is not capable of running as planned for any reason, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, programming errors, or technical failures, which, in the sole discretion of Sponsor, corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, the Sponsor may, in its sole discretion, void any suspect entries and: (a) terminate the Sweepstakes, or any portion thereof; (b) modify or suspend the Sweepstakes, or any portion thereof, to address the impairment and then resume the Sweepstakes, or relevant portion, in a manner that best conforms to the spirit of these Terms and Conditions; and/or (c) award the Prize from among the eligible, non-suspect entries received up to the time of the impairment in accordance with the winner selection criteria discussed above. The Sponsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process, the operation of the Sweepstakes, the Sweepstakes Website and/or the Sponsor Website, violates the Terms and Conditions, or acts with intent to annoy, abuse, threaten, or harass any other person.
Limitation of Liability and Releases
By participating in these Sweepstakes, entrants agree that the Sponsor has no liability whatsoever for, and shall be held harmless by entrants against, any liability for any injuries, losses or damages of any kind (including direct, indirect, incidental, consequential, or punitive damages) to persons or property resulting from a Prize, including the acceptance, possession, misuse or use of the Prize. Further, by participating in these Sweepstakes, entrants agree that the Sponsor has no liability whatsoever for, and shall be held harmless by entrants against, any liability for any injuries, losses or damages of any kind (including direct, indirect, incidental, consequential or punitive damages) to persons or property resulting from: a) entry or participation in these Sweepstakes, including access to and the use of the Sweepstakes Website or the Sponsor Website, or b) any claims based on personality or privacy rights, defamation, or merchandise delivery.
Without limiting the foregoing, the Sponsor, any of Sponsor’s suppliers or contractors shall not be responsible for: (a) any incomplete or inaccurate information that is caused by Sweepstakes Website users, Sponsor Website users or by any of the equipment or programming associated with or utilized in the Sweepstakes, or by any technical or human error which may occur in the processing of submissions in the Sweepstakes; (b) lost, interrupted, or unavailable network, server, service provider, on-line systems, telephone networks or telephone lines, or any other connections; (c) the theft, destruction, loss, or unauthorized access to, or alteration of, entries; (d) any problems with, or malfunctions or failures of, telephone networks or lines, computers or computer on-line systems, servers or providers, computer equipment, software, viruses or bugs; (e) garbled transmissions or miscommunications; (f) failure of any email, any Sweepstakes entry, any comment or any direct message to be received by or from the Sponsor for any reason, including but not limited to traffic congestion on the Internet or at any website or combination thereof or technical incompatibility; (g) damage to a user’s computer equipment (software or hardware) occasioned by participation in these Sweepstakes or in connection with the Sweepstakes Website or the Sponsor Website; or (h) any failure of the entry, draw, or other Sweepstakes process.
Interpretation
In the event of any conflict between these Terms and Conditions and any Sweepstakes information provided elsewhere (including but not limited in advertising or marketing materials), these Terms and Conditions shall prevail.
The headings of the sections of these Terms and Conditions are for convenience of reference only and shall not affect the interpretation of these Terms and Conditions.
Miscellaneous
By entering the Sweepstakes, each entrant agrees that (a) any and all disputes, claims, and causes of action arising out of or connected with the Sweepstakes, or any Prizes awarded, shall be resolved individually, without resorting to any form of class action; and (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorneys’ fees; and (c) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, special, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than for actual out-of-pocket expenses. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Terms and Conditions, or the rights and obligations of the entrants and Sponsor in connection with the Sweepstakes shall be governed by and construed in accordance with the Malaysian laws without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than Malaysia. Any legal proceedings arising out of this Sweepstakes or relating to these Terms and Conditions shall be settled in front of a competent Malaysian court, and each entrant consents to jurisdiction therein with respect to any legal proceedings or disputes of whatever nature arising under or relating to these rules or the Sweepstakes.
Severability
If any provision in these Terms and Conditions is held to be invalid, void, or unenforceable, such provision (or the part of it that is making it invalid, void or unenforceable) will be struck and will not affect the validity of and enforceability of the remaining provisions.
